A Missouri businessman has filed a first-of-a-kind lawsuit against requirement in ObamaCare that he provide for his employees free insurance coverage of contraceptives, sterilizations, and the “morning-after” pill.

The suit was filed by Frank O’Brien of O’Brien Industrial Holdings in St. Louis, which operates a number of businesses. As a Catholic, O’Brien is taking on the Department of Health and Human Services, asking the court to issue a permanent injunction prohibiting the HHS from requiring those who have religious objections to abide by the mandate.

Until now, only religious organizations and institutions have brought lawsuits challenging the mandate. The Supreme Court is set to begin hearing other arguments against ObamaCare next week.
