10/19/11: Mt. Soledad Dispute Headed for Supreme Court

Podcast: Download (Duration: 1:00 — 1.4MB)

The saga of the Mt. Soledad memorial cross continues, as plans now are to appeal the latest ruling against the cross to the U.S. Supreme Court.

The Ninth Circuit ruled that the Mt. Soledad memorial cross near San Diego — which has been used to honor veterans for more than 56 years — must be torn down.

The court voted 6-5 not to review or reverse a panel’s earlier ruling that called for removal of the cross. But Kelly Shackelford, chief counsel of Liberty Institute, tells OneNewsNow those five votes saying the cross is constitutional are important as the case goes now to the U.S. Supreme Court.

He also says the effort seeking the cross’s demise is an attempt by the American Civil Liberties Union to wipe religious expression and symbols from the public landscape.
