Judge Rules for Homosexual Couple in Benefits Case

An advocate for natural marriage says it’s not the role of the courts to overturn the 1996 Defense of Marriage Act. Chief U.S. District Judge James Ware of San Francisco ruled last week that it is discriminatory for the federal government to deny health insurance benefits to “gay spouses,” as it violates the promise to a discrimination-free workplace.
Peter LaBarbera of Americans for Truth About Homosexuality called the ruling a case of “judicial activism” adding, “One judge decides he doesn’t like a law, which was overwhelmingly passed by Congress and signed into law by a Democratic president, Bill Clinton.”
Ware has ordered the chief clerk of the San Francisco federal court to reimburse the principle in the court case for both the past and future costs of health insurance.
